These Terms govern access to and use of Athovia's Platform and Services. The separate Refund & Cancellation Policy, Privacy Policy, Disclaimer and Cookie Policy should also be reviewed before purchase or use.


1. INTRODUCTION

Welcome to Athovia ("Athovia", "we", "us", "our").

Athovia provides educational and examination-preparation services, training batches, diagnostic assessments, mock evaluations, learning resources, online classes, practice materials and related educational services through athovia.com and associated digital platforms (collectively, the "Platform").

These Terms & Conditions ("Terms") govern your access to and use of the Platform and your purchase or use of Athovia's services.

By accessing the Platform, creating an account, booking a diagnostic session, making a payment, enrolling in a course or otherwise using Athovia's services, you acknowledge that you have read and accepted these Terms.

If you do not agree with these Terms, you should not use the Platform or purchase Athovia's services.

These Terms are intended to operate in accordance with applicable laws of India, including applicable consumer-protection, information-technology, intellectual-property and data-protection laws, as amended or replaced from time to time.

2. DEFINITIONS

For purposes of these Terms:

  • "Athovia" means the sole-proprietorship business operating under the Athovia brand.
  • "User", "Student" or "you" means any person accessing the Platform or purchasing or using Athovia's services.
  • "Course" means any educational or examination-preparation programme offered by Athovia.
  • "Services" means courses, classes, assessments, mock tests, diagnostic sessions, educational resources, digital content and related services offered by Athovia.
  • "Course Materials" means Athovia-created or Athovia-licensed educational materials, including videos, worksheets, templates, practice materials, strategy documents, mock tests, evaluation materials, presentations, text, graphics and other learning resources.
  • "Batch" means a scheduled cohort or training cycle for a particular course.
  • "Trainer" means a person engaged or authorised by Athovia to deliver classes, conduct training sessions, provide instruction, evaluate student work, provide feedback, or otherwise support the delivery of the Services.
  • "Master Trainer" means a senior or specially designated Trainer responsible for advanced instruction, trainer mentoring, quality oversight, curriculum guidance, standardisation, or other responsibilities assigned by Athovia.
  • "Demo Trainer" means a Trainer or authorised representative who conducts demonstration, trial, sample, orientation, or introductory sessions for prospective or existing Students.
  • "Sales Team" means Athovia personnel or authorised representatives responsible for communicating information about Courses and Services, assisting prospective Students with enrolment, and supporting the sales or admission process.
  • "Front Desk" means Athovia personnel or authorised representatives responsible for reception, student assistance, scheduling coordination, general enquiries, and other administrative support at an Athovia centre or designated service location.
  • "IT Team" means Athovia personnel or authorised technical service providers responsible for the Platform, technology systems, user access, technical support, cybersecurity, connectivity-related support, and other technology functions.
  • "Operations Team" means Athovia personnel or authorised representatives responsible for operational coordination and administration of Courses and Services, including batch management, scheduling, student coordination, service delivery support, and related operational activities.
  • "Platform" means athovia.com and any Athovia-controlled online learning portal, application or digital interface used to deliver the Services.

3. ELIGIBILITY AND MINOR STUDENTS

3.1 Adults

Users aged 18 years or older may independently register for and purchase Athovia's Services.

3.2 Students below 18 years

Athovia may permit students below 18 years of age to access selected Services subject to applicable law and appropriate parental or lawful-guardian consent.

Where required by applicable law, Athovia will obtain or require verifiable parental or lawful-guardian consent before processing personal data of a child.

The parent or lawful guardian may be required to accept these Terms on behalf of the minor Student.

Athovia may restrict or discontinue access where required consent cannot be appropriately established.

4. ACCOUNT REGISTRATION AND SECURITY

Where account registration is required, Users must provide accurate and current information.

Users are responsible for maintaining the confidentiality of their login credentials and must not:

  • share account credentials with another person;
  • permit another person to access paid course content through their account;
  • attempt to circumvent access controls;
  • attempt to obtain unauthorized access to the Platform; or
  • use another person's account without authorization.

Users must notify Athovia promptly if they believe their account has been compromised.

Athovia may suspend access where an account appears to have been shared, misused or compromised.

5. COURSE ENROLMENT, FEES AND TAXES

5.1 Course enrolment

Course availability, duration, batch dates, class schedules, inclusions and applicable fees will be communicated at the time of enrolment or purchase.

Athovia may modify batch schedules where reasonably necessary, subject to the provisions of these Terms.

5.2 Payment

Unless an alternative payment or instalment arrangement has been expressly approved by Athovia in writing, course fees and applicable charges are payable before commencement of the relevant Batch or Service.

Payments may be processed through third-party payment gateways or other authorised payment service providers.

5.3 Taxes

Applicable statutory taxes, including GST where applicable, may be added to the advertised price or otherwise reflected at checkout or on the applicable invoice.

Users are responsible for reviewing the final payable amount before completing a purchase.

5.4 Payment information

Athovia does not intentionally store complete credit/debit card numbers, CVV details or net-banking credentials on its own internal servers.

Payment information may be processed directly by authorised third-party payment providers in accordance with their applicable terms and security practices.

6. REFUND & CANCELLATION

Refunds and cancellations are governed by Athovia's separate Refund & Cancellation Policy, which forms part of the contractual terms applicable to the relevant Course or Service.

The Refund & Cancellation Policy is available on athovia.com and should be reviewed before purchase.

7. BATCH TRANSFERS

A Student may request up to two (2) transfers to a future training cycle, subject to availability and Athovia's approval. Athovia may consider the reason for the transfer request when determining whether to approve it.

The request should be submitted to info@athovia.com at least seventy-two (72) hours before the original Batch commencement date.

A transfer requested beyond the two permitted transfers may be subject to an administrative re-allocation charge of up to 10% of the course fee paid, where applicable and as disclosed to the Student.

A transfer is not guaranteed and depends on:

  • availability in the requested future Batch;
  • course compatibility;
  • timing of the request; and
  • compliance with applicable administrative requirements.

8. COURSE ACCESS AND SERVICE DELIVERY

Athovia will make reasonable efforts to deliver the Services substantially as described at the time of purchase.

Athovia may reasonably modify:

  • class schedules;
  • instructors or tutors;
  • Platform interfaces;
  • learning tools;
  • assessment methodologies;
  • technical systems; or
  • individual Course Materials,

provided that such changes do not materially reduce the core educational Services or training hours purchased by the Student.

Where a significant change materially affects the purchased Service, Athovia will endeavour to provide an appropriate alternative or remedy, subject to applicable law.

9. INTELLECTUAL PROPERTY

9.1 Athovia intellectual property

Athovia owns or has the necessary rights to use the intellectual property contained in the Platform and Athovia-created Course Materials, including, where applicable:

  • video lessons;
  • live-class recordings;
  • presentations;
  • worksheets;
  • practice materials;
  • strategy documents;
  • templates;
  • mock-test materials;
  • evaluation frameworks;
  • written content;
  • graphics;
  • logos;
  • website content; and
  • Platform design and functionality.

Nothing in these Terms transfers ownership of Athovia's intellectual property to a Student.

9.2 Limited personal-use licence

Subject to payment and continued compliance with these Terms, Athovia grants the Student a limited, non-exclusive, non-transferable and revocable licence to access and use purchased Course Materials solely for the Student's personal educational purposes.

The Student may not commercially exploit or redistribute Course Materials.

9.3 Prohibited activities

Unless Athovia has provided prior written permission, Users must not:

  • record or screen-capture live classes, feedback sessions or other instructional interactions;
  • download or reproduce restricted digital content;
  • distribute, sell, publish or republish Course Materials;
  • upload Athovia materials to public or private cloud repositories for third-party access;
  • share paid materials through messaging groups, forums or social media;
  • share login credentials;
  • reverse-engineer Platform security or software;
  • scrape or automatically harvest Course Materials;
  • use bots or automated systems to extract substantial website content; or
  • use Athovia materials to create or operate a competing commercial service.

Nothing in this clause restricts rights that cannot lawfully be restricted.

10. USER-SUBMITTED CONTENT

Students may submit essays, answers, speaking samples, recordings, assignments, feedback or other material for educational evaluation.

The Student retains ownership of their original content, subject to any rights belonging to third parties.

By submitting content, the Student grants Athovia a limited, non-exclusive right to store, reproduce, review and process the content to the extent reasonably necessary to:

  • provide the requested educational Services;
  • assess performance;
  • provide feedback;
  • maintain academic records;
  • troubleshoot or improve the Platform; and
  • comply with legal obligations.

Athovia will not use a Student's identifiable submission for public marketing or promotional purposes without appropriate permission where such permission is required.

11. CLASS RECORDINGS, AUDIO AND VIDEO

Where classes, assessments, feedback sessions or other instructional interactions are recorded, Athovia may process the recording for purposes such as:

  • delivering or reviewing the Service;
  • quality assurance;
  • student feedback;
  • academic assessment;
  • maintaining appropriate educational records; and
  • resolving disputes or technical issues.

Where required by applicable law, Athovia will provide appropriate notice or obtain the required consent.

Where a class, assessment, feedback session or other instructional interaction is recorded, Athovia will, where reasonably practicable, notify participants at or before the commencement of the recording and indicate the principal purposes for which the recording will be used. Such notice may be provided through the Platform, meeting interface, class communication, or another appropriate method.

Students must not independently record, reproduce or distribute instructional sessions without Athovia's permission.

12. STUDENT CODE OF CONDUCT

Students are expected to maintain a respectful and professional learning environment.

The following conduct is prohibited:

  • harassment;
  • bullying or cyber-bullying;
  • threats;
  • abusive or discriminatory conduct;
  • persistent disruptive behaviour;
  • impersonation;
  • academic dishonesty;
  • plagiarism;
  • unauthorised sharing of account credentials;
  • unauthorised distribution of Course Materials;
  • attempts to compromise Platform security;
  • fraud or misuse of payment systems; and
  • unlawful activity.

Athovia may suspend or terminate access where reasonably necessary because of serious misconduct, material breach, security concerns, unlawful activity or conduct that materially disrupts the learning environment.

Where reasonably practicable, Athovia may provide notice or an opportunity to remedy a breach. Immediate suspension may be imposed where necessary to protect Students, staff, systems, intellectual property or other legitimate interests.

13. REVIEWS, COMPLAINTS AND FREEDOM TO REPORT CONCERNS

Nothing in these Terms prevents a Student from:

  • submitting a genuine complaint;
  • seeking statutory consumer remedies;
  • providing an honest review;
  • reporting suspected misconduct; or
  • exercising any other lawful right.

Athovia may take action against content or conduct that is knowingly false, unlawful, threatening, abusive, harassing or defamatory, subject to applicable law.

14. EXAMINATION AND AFFILIATION DISCLAIMER

Athovia is an independent educational preparation and training provider.

Unless expressly stated otherwise, Athovia is not affiliated with, endorsed by, sponsored by, or officially associated with IELTS, British Council, IDP Education, Cambridge University Press & Assessment, or any other examination authority or test provider.

Examination names and trademarks remain the property of their respective owners.

Examination formats, scoring systems, registration requirements, test dates and other official requirements may change.

Students should verify official examination information directly with the relevant examination authority.

14A. EXAMINATION REGISTRATION RESPONSIBILITY

Students are solely responsible for registering for any external examination, selecting their examination date and location, paying examination fees, submitting required documents and complying with the applicable examination authority's requirements. Athovia does not control examination registration, scheduling, test-centre availability, examination fees or the policies of external examination authorities. Students should independently verify all official examination information and requirements with the relevant examination authority.

15. NO GUARANTEE OF RESULTS

Athovia provides educational preparation, training, practice and examination strategies.

However, Athovia does not guarantee:

  • a particular examination band score;
  • a particular examination result;
  • admission to a university or institution;
  • immigration or visa approval;
  • employment;
  • scholarship approval; or
  • any other outcome controlled by an examination authority, educational institution, employer or governmental authority.

Individual results depend on numerous factors, including the Student's preparation, attendance, performance, examination conditions and official assessment.

15A. AI-ASSISTED SERVICES

Athovia may use artificial intelligence or automated technologies in certain educational, assessment, administrative or student-support functions. Where applicable, AI-assisted outputs are intended to support learning and may not always be accurate, complete or equivalent to an assessment conducted by a qualified human evaluator. Students should not rely solely on automated outputs for high-stakes examination, admission, immigration, employment or other consequential decisions. Where required by applicable law, Athovia will provide appropriate notice concerning the use of such technologies.

16. THIRD-PARTY SERVICES AND LINKS

Athovia may use third-party service providers for payment processing, hosting, communications, learning delivery, analytics, customer support, scheduling, cloud storage and other operational purposes.

The Platform may also contain links to third-party websites or services.

Athovia is not responsible for the independent terms, privacy practices, availability or content of third-party services.

Students should review the relevant third-party terms and privacy policies where appropriate.

17. DISCLAIMERS

The Platform and Services are provided on a reasonable-efforts basis.

Athovia does not guarantee that:

  • the Platform will always be uninterrupted;
  • every feature will always be available;
  • all technical errors will be immediately corrected; or
  • the Platform will be compatible with every device, network or software environment.

Athovia will nevertheless use reasonable efforts to maintain and improve the Services.

Nothing in these Terms excludes or limits any liability or consumer right that cannot lawfully be excluded or limited under applicable law.

18. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Athovia, its proprietor, employees, tutors, contractors and service providers will not be liable for indirect, incidental, special or consequential loss arising from use of the Platform or Services.

To the maximum extent permitted by applicable law, Athovia's aggregate liability arising out of or relating to a particular Course or Service will not exceed the amount actually paid by the Student to Athovia for that Course or Service.

This limitation does not apply to liability that cannot lawfully be excluded or limited.

19. INDEMNITY

To the extent permitted by applicable law, a User may be responsible for losses, claims, liabilities and reasonable legal costs arising from:

  • the User's material breach of these Terms;
  • unauthorised distribution of Athovia's intellectual property;
  • unlawful recording or distribution of instructional content;
  • misuse of another person's account;
  • fraudulent activity; or
  • unlawful conduct carried out through the User's account.

Nothing in this clause creates an obligation beyond what is permitted under applicable law.

20. FORCE MAJEURE

Athovia will not be responsible for delay or failure caused by circumstances beyond its reasonable control, including:

  • natural disasters;
  • severe weather;
  • fire;
  • strikes or lockouts;
  • widespread power outages;
  • major internet or telecommunications failures;
  • governmental restrictions;
  • civil disturbance;
  • cyberattacks or significant distributed denial-of-service attacks;
  • failures of essential third-party infrastructure; or
  • other events beyond Athovia's reasonable control.

Where reasonably practicable, Athovia will attempt to restore affected Services or provide an appropriate alternative.

21. CHANGES TO SERVICES AND TERMS

Athovia may update these Terms from time to time to reflect:

  • changes in law;
  • changes to the Services;
  • changes to technology;
  • security requirements; or
  • operational improvements.

The updated version will be published on the Platform with an updated revision date.

Where applicable law requires specific notice or consent, Athovia will follow the applicable requirement.

22. DISPUTE RESOLUTION

If a Student has a complaint or dispute, the Student should first contact:

The written complaint should describe the issue and the resolution sought.

Athovia will endeavour to acknowledge and review valid complaints within a reasonable period and, where practicable, provide a response within five (5) business days for routine enrolment, payment or cancellation matters.

For more complex disputes, the parties may attempt good-faith resolution before pursuing formal legal remedies.

Nothing in this section prevents either party from exercising a statutory right or seeking relief from a competent authority where permitted by law.

23. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by the laws of India.

Subject to any mandatory jurisdiction or consumer-protection rights available under applicable law, courts having competent jurisdiction in New Delhi, India shall have jurisdiction over disputes arising from these Terms or the Services.

24. SEVERABILITY

If any provision of these Terms is held to be unlawful, invalid or unenforceable, that provision will be modified or severed to the extent necessary, without affecting the validity of the remaining provisions.

25. ENTIRE AGREEMENT

These Terms, together with the applicable Course description, order/checkout information, Refund Policy and Privacy Policy, constitute the principal terms governing the User's relationship with Athovia regarding the relevant Services.

Where a specific written agreement has been separately entered into between Athovia and a User, that agreement will prevail to the extent of any direct conflict.
